Understanding Statutory Maternity Pay

If you are expecting a baby, you may be eligible for Statutory Maternity Pay.  This is a payment that will be made by your employer while you are Maternity Leave.

Are You Eligible For Statutory Maternity Pay?

To determine your eligibility, you must meet the following requirements:

  • Employed by the same employer for a consecutive 26 weeks and into the 15th week before the baby is due
  • Earning an average of £84 per week prior to taxes

 

How Much Is Statutory Maternity Pay?

You may claim your benefits in two manners:

  • 90% of your average weekly earnings for the first 6 weeks of your maternity leave
  • Either £108.85 or 90% of your average earnings (if your average earnings is less than £108.85 for the remaining 20 weeks)


How Do You Get Paid?

You will receive your payment in the same manner that you earn your normal wages. 

Maternity Pay is treated as wages and your employer will be required to deduct taxes and National Insurance.

How Do You Claim It?

To claim Statutory Maternity Pay you must alert your employer at least 28 days prior to your intended day of stopping work.  Your employer may require this notice in writing. 

You may also change your mind on the date that you choose to receive your payments, but you are still required to notify your employer 28 days prior to the new date. 

You must also provide evidence of pregnancy and the baby’s due date through a maternity certificate that you will receive from your doctor or midwife 20 weeks before the due date.
